Terms of Service

The End User agrees:

• It shall have a non-exclusive and non transferable right to use Wealthwise for its own individual financial and money management purposes and only the End User through its registration and login code is permitted to utilise Wealthwise ; The sharing of any licensed End User logon/password details with another non-licensed user is not permitted under any circumstances.
• All copyright and other intellectual property in Wealthwise and all associated documentation, business plans, concepts, ideas, brands, formulae, technical specifications and marketing material including its “look and feel” (e.g., text, graphics, images, logos and button icons), photographs, editorial content, notices, software (including html-based computer programs)shall remain the property of Viridian Solutions Limited, a New Zealand registered company.
• It shall not reverse engineer, decompile, disassemble or apply any process, technique, procedure or make any attempt to ascertain or derive the source code to Wealthwise into a human understandable format except to the extent expressly permitted by applicable law and to the extent that Viridian Solutions Limited is not permitted by that applicable law to exclude or limit the right of End User to do so,
• It will not use any robot, spider, scraper, deep link or other similar automated data gathering or extraction tools, program, algorithm or methodology to access, acquire, copy or monitor Wealthwise.co.nz or any portion of Wealthwise, without the express written consent of Viridian Solutions Limited which may be withheld at its sole discretion,
• Use or attempt to use any engine, software, tool, agent, or other device or mechanism (including without limitation browsers, spiders, robots, avatars or intelligent agents) to navigate or search wealthwise.co.nz, other than the search engines and search agents available through Wealthwise and other than generally available third-party web browsers (such as Microsoft Explorer),
• Not to post or transmit any file which contains viruses, worms, Trojan horses or any other contaminating or destructive features, or that otherwise interfere with the proper working of Wealthwise,
• The End User will not permit any third parties to benefit from the use or functionality of the software via a timesharing, service bureau or other arrangement.

Viridian Solutions Limited will have no liability or responsibility to End User for any loss, damage or injury whether arising in contract, tort, equity or otherwise which occurs directly or indirectly from a breach of this licence agreement including:

• Loss Of Profits Or Sales;
• Loss Of Bargain;
• Loss Of Opportunity;
• Loss Of Use Of Any Software Or Any Other Computer Equipment, Software Or Data;
• Loss Of Time On The Part Of Management Or Other Staff;
• Any Other Indirect Or Consequential Loss.

Viridian Solutions Limited shall have no liability whatsoever to either the End User or the End User client(s) for any consequential loss, damage (including but not limited to, damages for loss of business profits, business interruption, loss of business information and the like) or injury arising in contract, tort, equity or otherwise in respect of any service provided by, or act or omissions of, including any third party who provides services to End User by, through or in relation to Wealthwise.
